  • Filing a Chapter 7 and getting a discharge will show a $0.00 balance on all of your unsecured debts (besides student loans, restitution, back child support and some taxes) therefore your debt-to-income ratio is drastically changed which will help your credit more than hurting it. Filing a Chapter 13 means over 5 years you will be paying back your debts so during that 5 years you can not obtain new debts (without court approval) but your credit, in the end, will increase.

  • Not true. With Chapter 7 you can buy a car within months of filing, you can buy a house within 2 years of your discharge. With Chapter 13, you’re not to obtain any new debts without getting the Court's approval but it can be done, if necessary.

  • It depends but generally, no. If you’re filing a Chapter 7 and you do not have a lot of equity in your home (over $16,450) or a vehicle worth a lot more than you owe, there is no reason you would lose either, as long as your finance payments are current. In Chapter 13, no. Chapter 13 is payback court so there is no reason to lose anything while in Chapter 13. I will not put anyone in Chapter 7 or Chapter 13 if there is a possibility they may lose their house or car unless they want to surrender them.

  • We have to list ALL debts you owe, including all credit cards. Credit card companies will close your account once you file for Chapter 7 or Chapter 13. Typically after a chapter 7 is filed you will begin to receive A LOT of credit card pre-approval letters. Creditors know you can only file once every 8 years so they have no reason not to offer you credit.

  • No. In Chapter 7/13, if you do not have more than $16,450.00 equity in your home, a lien can be Avoided thru a “Motion to Avoid Judicial Lien”

  • YES! As long as a case is filed before the foreclosure sale, your house can be saved! The mortgage arrearage will go into a Chapter 13 case and it can be paid through the 5-year plan.
